SHOP vs. ICHRA: Which Is Right for Your Small Business?
See how these two paths actually compare for employers in PA, NJ, and DE, so you can choose with confidence.
Two Very Different Paths
The right structure depends on your team, your goals, and what's actually available where you are.
How It Works
SHOP means picking one group plan for your whole team. ICHRA means setting an allowance and letting each employee choose their own individual plan.
Availability Right Now
SHOP is currently limited across this region. Pennie isn't running a SHOP program in PA, NJ's SHOP has only one participating carrier, and DE has no state-run exchange for it at all, so SHOP plans there go through the federal marketplace process directly. ICHRA doesn't depend on carrier participation the same way.
Tax Treatment
Enrolling in SHOP is generally the only way to access the Small Business Health Care Tax Credit. ICHRA offers tax-free reimbursements through a different structure, without that specific credit.
Compliance Applies Either Way
Whether you go with SHOP or ICHRA, ACA and IRS rules still apply, from employer mandate requirements to affordability calculations. Your advisor helps you figure out which path actually fits your business, then stays with you to help you stay compliant once you're there.
SHOP vs. ICHRA: Side by Side
| SHOP | ICHRA | |
|---|---|---|
| How plans are chosen | Employer picks one group plan for the team | Employer sets an allowance, employee picks their own plan |
| Employee plan choice | Limited to the plan offered | Any ACA-compliant individual plan |
| Availability in PA, NJ, DE | Currently limited, no PA program, one NJ carrier, DE via federal marketplace only | Not tied to carrier participation the same way |
| Tax treatment | May qualify for the Small Business Health Care Tax Credit | Tax-free reimbursements, different structure, no SHOP-specific credit |
| Employees across multiple states | Tied to where the group plan is licensed | Generally works across state lines, since employees buy individually |
| Enrollment timing | Generally year-round through a carrier or broker | Can generally be set up anytime with proper employee notice |
Frequently Asked Questions (FAQs)
Can I offer both SHOP and ICHRA?
Generally not to the same employees. Employers typically choose one approach for a given group of employees, though it's possible to use different structures for different employee classes. Your advisor can walk through what makes sense for your specific setup.
Is SHOP available in Pennsylvania?
Not through Pennie directly, Pennie is not currently operating a SHOP program. PA employers interested in SHOP coverage generally work with an insurance company directly or a SHOP-registered broker instead.
Does ICHRA still offer any tax advantages?
Yes. ICHRA reimbursements are generally tax-free to employees, though ICHRA doesn't provide access to the Small Business Health Care Tax Credit, which is generally tied to SHOP enrollment specifically.
